Disclaimer & Terms:  This Market Listener service is intended to be purely for your own education.  It is not intended to be trading or investment advice.  
							
							1.	Our published YTD, 6 month and 12 month gains/losses are merely hypothetical indicators of whether our approach would work under actual trading and investing conditions.  We do not publish our model's back-tested results earlier than 2004 since our system is discretionary and past performance is no predictor of future gains.  We do reserve the right to publish current or past records of theoretical results acting on a hypothetical account for other market sectors & indexes.  We cannot guarantee future results, but we believe that the educational aspects of our service are well worth the suggested subscription fees.
							
							2.	The Market Listener service reports will be updated at least 46 times per calendar year and will include mid-week email advisories issued at the discretion of the publisher.
							
							3.	Subscriptions are not subject to automatic renewal.
							
							4.	A warning about email alert timing. We are attempting to give educational, not trading advice. We would hope that we can send emails indicating signal changes 2 hours prior to the close so that you can use them in real time to make your own trading decisions for that day.  However, this may not be possible every time a signal is necessary.  Our goal is to give YOU the tools, MACD parameters, cash stop exit levels, etc. so that YOU can make your own trading decisions without our input. We do not have, and should not be considered to be an automated alert service.  We attempt to publish new signals in real-time as proof that our educational techniques are valid.
							
							5.	The Market Listener cannot be held responsible for untimely or blocked delivery of internet or email communications and alerts caused by spam blockers, ISP's or service Hosts.
							
							6.	At times, the owners of Listening Partners, LLC may have some financial positions in the market which are not consistent with the signals generated by the service.
							 
							7.	All materials published on the Market Listener website or via periodic emails are considered to be copyrighted, proprietary, intellectual property materials which are the property of Listening Partners, LLC.  You agree not to distribute, reproduce or revise and distribute, in any way, these materials to non-subscribers except as noted under Institutional Subscriptions below.
							
							8.	By subscribing to our service, you agree to the above terms and agree to hold harmless, the publisher, Listening Partners, LLC for any negligence, omission or force majeure.
							 
							9.	Institutional Subscriptions are payable by the firm’s check only.  Institutional subscriptions permit internal distribution of Market Listener website information and emails.  Multiple user-names and passwords can be made available for internal firm use only.
							 
							10.	We have no affiliation with Rydex Funds or ProFunds or any financial adviser or stock broker or company.
							 
							Refunds:  Potential subscribers will have the opportunity of reviewing certain portions of our website and previous reports and hypothetical results.  Since samples of our educational materials are available to potential subscribers, no refunds of subscriptions will be given after the subscription start date.  If you believe that your particular situation warrants a partial refund, we will consider your special request.

Market Listener's Commitment to Privacy
We wish to respect your privacy. We do not sell or otherwise distribute your email addresses or any personal information. We do request and will retain your address and telephone number in your City, State and Country of residency only as required for our Texas tax liabilities and to provide an alternate method to contact you in the event of email failure.

We do not store any credit card data on your subscription as the credit card billing is out-sourced to PayPal or others and is not subject to automatic renewals.

Refunds on subscription fees are not permitted except as described in the Disclaimer and Terms, but you can have your email address(es) and contact information removed from our records at any time at your request should you decide to suspend our service.
